GENERAL CONDITIONS OF SALE
We advise you to print out these general conditions of sale and read them carefully. The following clauses set out the general conditions of sale to which the booking services of the BISOUX S.L company and its brand name Cyberandorra are subject.
ARTICLE 1. DEFINITION AND FIELD OF APPLICATION
1.1. DEFINITION
“You” or “the User” means any user of the Cyberandorra.com site who makes a booking, orders and/or buys any product or service offered by Cyberandorra.com and/or the Bisoux SL Agency in the name of its Partners. “Partner” means any supplier of Products and/or Services to Cyberandorra.com and Bisoux SL Agency offered on the site. The term “Partner” includes in particular hoteliers, service providers as suppliers, subsidiaries, insurance companies, providers of other Services and suppliers of Products.
“Product” means any material goods sold by Partners.
“Service” means the provision of Services, such as providing facilities, accommodation, tourism packages, “Leisure +”, insurance cover, or any other service provided by Cyberandorra.com or the Bisoux SL Agency, in the name of their Partners.
1.2. FIELD OF APPLICATION
These general conditions of sale and use (hereafter known as “The General Conditions”) apply to all the goods and services offered on the site by Cyberandorra.com and/or the Bisoux SL Agency in the name of their partners.
Making orders is reserved for users who have read these General Conditions in their entirety, as well as the conditions specific to the partners concerned with each product and/or service, before making each order, and have accepted them without reservation. Making an order carries with it the complete and entire acceptance of these General Conditions and conditions specific to the partners concerned with the order.
Cyberandorra.com and/or the Bisoux SL Agency reserve the right to modify these General Conditions at any time, without prior notice, on the understanding that such modifications will not be applied to bookings already accepted previously by Cyberandorra.com and/or the Bisoux SL Agency.
You undertake to abide by the Partners’ Specific Conditions, and especially to pay all sums due, and to accept the conditions and limitations of responsibility relating to the availability of products and services offered.
ARTICLE 2. ORDERING ON THE www.cyberandorra.com SITE
2.1. CAPACITY
The site’s function is to assist you in looking for products and services relating to hotels and tourist facilities, and to make appropriate bookings, or any other transaction with partners. You must be at least 18 years of age, with the legal capacity to enter into contracts, and use this site in accordance with these General Conditions.
You are financially responsible for using the Site, in your name or for any third party, including minors, except in cases of fraudulent use which does not result from any fault or negligence on your part. In addition, you guarantee that information provided by you, or any third party using your details, on this site is true and correct.
Cyberandorra.com will refuse access at any time to the services offered on the aforementioned site to anyone who makes any use of the booking service on this site which is fraudulent or would contravene these General Conditions.
2.2. MAKING AND CANCELLING ORDERS
You can order goods or services which are available from the site, once you have accepted these general conditions, as well as any conditions specific to partners which might be applicable.
The ordering procedure involves at least the following steps:
- Once you have requested a specific product or service, the site will suggest one or more possibilities.
- You click on the possibility(ies) which you choose.
- A reminder of the choices you have made and the total price of your choice(s) allows you to verify the details of your order.
- You can then validate your order, provided that you have accepted these General Conditions.
The contract with Cyberandorra.com and the partner concerned in the offer is then concluded.
- If applicable, you can pay for your order on-line using a secure system, under conditions described below (article 6).
- When the payment is authorised, Cyberandorra.com, in the name of its partners, will send you an e-mail confirming the order, repeating the elements such as the identification of the product or service ordered, the price, the quantity, any possible discounts or reductions agreed, and the availability date.
- For this, it is your responsibility to ensure that the details which you enter when you book are correct, and that they will enable you to receive confirmation of your order and your payment. If you do not receive this confirmation, it is up to you to contact Cyberandorra.com as quickly as possible (article 8).
Neither Cyberandorra.com nor the Bisoux SL Agency can accept any responsibility if you do not receive the order because of a mistake you have made in entering your details.
All terms for cancellation, possible rectification of orders and/or reimbursement are defined in these conditions and/or partners’ specific conditions.
There will be no reimbursement for costs or insurance taken out under any circumstances.
2.3.DELIVERY
Upon acceptance of your payment by the banking establishment, you will receive a booking voucher by e-mail, serving as an invoice and proof of purchase for what you have purchased on the site. You should print this out, to present it to the various providers on your arrival.
This delivery will take place to the e-mail address which you gave during your order. If the delivery of this voucher is impossible due to an error or omission on your part during the entering of your details, neither Cyberandorra.com nor the Bisoux SL Agency can be held responsible.
In spite of all of our efforts, it is possible that a small number of the rooms featured on our site have an incorrect price. If the corrected price is less than that displayed on our site, we will apply the lower price. If the corrected price is greater than that displayed on the site, then we will inform you of this and, if you choose not to accept the order at the new price, then we will cancel it upon your request.
2.4.EVIDENCE
It is expressly agreed that, barring any obvious error which you report, the data retained in the Cyberandorra.com system will be evidence of the orders which you have made.
Data kept electronically or on computer by cyberandorra.com or by the Bisoux SL Agency will constitute evidence in any litigation or other matter. They are admissible and valid between the parties in the same way, under the same conditions and with the same evidential weight as any document which may be drawn up, received, or retained in writing.
ARTICLE 3. PROVISION OF ACCOMMODATION
Taking possession of rooms
In most cases, rooms will not be available until after 2.00pm and must be vacated before midday, whatever the time of arrival or departure or the means of transport used.
Single rooms generally include a single bed. These rooms are often subject to a supplement. Double rooms are provided with either twin beds or a double bed.
Classification
The indication of the level of comfort attributed to hotels included in the descriptions to be consulted on the site corresponds to a classification drawn up according to the standards of Andorra, and so can differ from the other countries in Europe.
Activities offered
It could be that certain activities offered by the partners of the Bisoux SL Agency and mentioned in the descriptions on the site may not be available, particularly due to reasons of weather or in cases of force majeur.
Moreover, if this happens, the description on the site specifies that certain activities are not necessarily available out of the holiday season or that they are conditional upon a certain minimum number of participants signing up. In such cases, the Bisoux SL Agency will not be responsible for these activities not taking place.
Meals
Full board includes breakfast, lunch and dinner, depending upon the package. Full board and half board begin with the meal preceding the first night and end with breakfast following the final night’s accommodation. Unless specified to the contrary, drinks are not included and payment for them remains your responsibility.
ARTICLE 4. CANCELLATION AND MODIFICATION
Cancellation
It is imperative that any request for cancellation or modification should be made to the Bisoux SL Agency by email or fax, and they will pass it on to their partners.
Apart from specific situations mentioned by the providers, the following schedule will apply:
- between 30 and 21 days before the first night: 40% of cost;
- between 14 and 8 days before the first night: 75% of cost;
- from 7 days before the first night: 100% of cost.
Any disrupted or shortened stay and any non-consumed service for any cause cannot be refund.
Complaints
Complaints of a commercial nature or which concern the quality of what is offered should be addressed no more than 3 months after the end of the stay to the Bisoux SL Agency by registered letter requiring a receipt, and they will pass it on to their partners. After this period of time has elapsed, no complaint will be considered.
Complaints will only be accepted where the Bisoux SL Agency was informed about the problems which they concern during the stay, so that the partners can attempt to remedy them to reduce the harm suffered.
Photos and illustrations
The Bisoux SL Agency through its site Cyberandorra makes the greatest efforts to supply photos and illustrations to give you an idea of the accommodation being offered by the chosen hotel. These photos and illustrations are intended to show you the degree of comfort or the category of hotel concerned, and do not form a contract in any way.
ARTICLE 5. FINANCIAL CONDITIONS AND PAYMENT METHOD
The descriptions of the products or services presented on this site specify what is included in the price for each of them. Prices are shown in Euros and include all taxes.
Paying for what is offered takes place once the sale is effected through our secure payment system. Payments made on the Cyberandorra.com site are made by bank card (cards from the Visa, Eurocard/Mastercard networks are accepted) through a secure payment system. In the case where a payment is irregular, incomplete or non-existent, for a reason which is attributable to you, the sale of the goods or services will be cancelled, and the resulting costs will be your responsibility, with civil and/or criminal action possibly taken against you.
ARTICLE 6. INTELLECTUAL PROPERTY
The Bisoux SL Agency or Cyberandorra.com retain all rights of intellectual property relating to the site or hold usage rights pertaining to it. Visiting the site does not give you any rights over the intellectual property relating to the site: this remains the exclusive property of Cyberandorra.com or the Bisoux SL Agency.
Elements which can be accessed on the site, particularly in the form of text, photographs, images, illustrations, icons, sounds, video, software, a database or data are equally protected by the rights of intellectual and industrial property which the Bisoux SL Agency and Cyberandorra.com hold.
Any use of all or part of the site not previously authorised by the Bisoux SL Agency or Cyberandorra.com, for whatever purpose or in whatever way, may give rise to the appropriate action, particularly an action against counterfeiting. The only thing which may be used is a small part of the site, for strictly personal and commercial purposes.
The insertion of hypertext links to any part of the site is forbidden without prior authorisation in writing from Cyberandorra.com.
ARTICLE 7. INSURANCE
No insurance is included in the prices shown on the site. In view of this, the Bisoux SL Agency through Cyberandorra.com recommends that insurance cover is taken out to cover products and services covering the consequences of certain cases of cancellation and assistance covering certain risks, particularly repatriation costs in the case of accident or illness.
To this end, different forms of insurance are offered, and these can be taken out with ELVIA Assurance Voyages, at 153 Faubourg Saint Honoré, 75381 PARIS cedex 08, siret (company registration number) n°5820754300017
If insurance is taken out, the insurance policy is accessible via a hypertext link included in the description on the order form.
Declarations of damage, accident etc are to be made directly to the insurance company, under the terms of the insurance contract.
ARTICLE 8. TOURIST SERVICES
These services are offered by Cyberandorra.com in the name of its providers. They are specifically listed, non-modifiable and non-refundable.
Unless indicated otherwise on the site, the sale of services is governed by the clauses in these general conditions of sale. It could be that some services offered by providers on Cyberandorra.com and included in the descriptions on the site might be unavailable, particularly due to reasons of weather, in cases of force majeur, or when the number of participants is less than that required for the activity to take place.
ARTICLE 9. OTHER PRODUCTS OR SERVICES
Through the site, you can order other products and services from associated companies. The sale of these products is directly between you and these companies. The sale of such products or services is governed exclusively by the specific conditions of these companies.
